The following are some important things to rememer if you have been in an accident, from a legal point of view;
Call the Gardaí
Calling the Gardaí, especially after a car accident, is very important. Even if the Gardaí do not attend at the scene reporting the accident will create an offical record of the incident. That way, if the other party later denies the incident, the garda statment or record can be used as evidence.
Preserve Evidence
The more evidence you have of the incident the better. Most people these days have a camera on their phone. Take as many picures as possible from differnet viewpoints. Crucially, record the licence plate of the vehicle, name, address, contact numbers and insurance details. Also, record the names and contact numbers of any witnesses. Do not rely solely on insurance details, it is possible that the person is using false insurance details.
Get Medical Help
If you have been in an accident your health is the primary concern. Even if you feel fine, you should go to a doctor to get a professonal opinion. Injuries following an accident can take often take time before showing sympotoms. The Personal Inuries Board or a court will look for all medial reports in relation to the incident. Insurance companies may try to reduce your claim if you did not seek prompt medical advice.
Seek Legal Advice
If you are making a claim it is important to seek legal advice as soon as possible. The sooner you seek advice the sooner your case can be orgainised and any potential issued identified. It is importatnt to remember that if you accept a settlement you will forfeit any claim. Also, there are strict time limits in relation to personal injury claims.
